ONLINE STORE TERMS AND CONDITIONS

§1 [GENERAL PROVISIONS]

  1. The online store operating at the web address www.dazer.store (hereinafter referred to as the “Store”) is run by the company DAZER SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at UL. GEN. ROMUALDA TRAUGUTTA 143 / 1B, 50-419 WROCŁAW, NIP: 8993019545, KRS: 0001161360 (hereinafter referred to as the “Seller”).
  2. This Terms and Conditions (hereinafter referred to as the “Terms”) aims to specify the rules of operation of the online store, the terms of placing orders, concluding sales contracts for products offered in the Store, as well as rules of payment, delivery of ordered products and complaint procedures. The Terms also include rules related to personal data protection and the responsibilities of the Seller and the Client in relation to purchases made in the Store.
  3. A Client of the Store can be any natural person, legal person, or an organizational unit without legal personality, who purchases products offered by the Store for purposes not directly related to their business or professional activity, i.e., a consumer. The Store Client can also be an entrepreneur who makes purchases for purposes related to their business or professional activity.
  4. Using the Store is possible after meeting certain technical requirements. The Client should have internet access and a device enabling use of a web browser. The technical requirements for proper use of the Store are minimal and include access to the latest version of one of the popular web browsers.

 

§2 [STORE OFFER]

  1. The online Store offers a wide range of products that are described in detail on the Store’s pages, including names, pictures, prices, and other information important for the Client. Products offered in the Store are brand new, free from legal defects, unless otherwise stated in the product description.
  2. Prices of all products offered in the Store are given in Polish zloty (PLN) and include VAT. Prices may change, but such changes do not affect already placed orders. Prices do not include delivery costs, which are specified separately and provided during the order placement process.
  3. Products in the Store are offered both for retail and wholesale sale, depending on the needs and expectations of the Clients.

§3 [CONTRACT CONCLUSION]

  1. By placing an order in the Store, the Client makes an offer to conclude a sales contract for the products covered by the order. The contract is concluded at a distance.
  2. The sales contract between the Client and the Seller is concluded at the moment when the Seller sends the Client an email confirming the acceptance of the order for processing. This confirmation is equivalent to concluding the sales contract for the products ordered by the Client.
  3. The Client can place orders 24 hours a day, 7 days a week. Order processing begins only after payment for the ordered goods is credited to the Seller’s bank account.

 

§4 [PERSONAL DATA]

  1. The administrator of the Client’s personal data is the Seller, DAZER SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, located at [Address].
  2. The Client’s personal data will be processed in accordance with applicable laws, including the Privacy Policy available on the Store’s website. The Privacy Policy specifies in detail the purposes and rules for processing Clients’ personal data.
  3. By making a purchase in the Store, the Client consents to the processing of their personal data by the Seller for the purpose of order fulfillment, and, if a separate consent is given, for marketing purposes. The Client has the right to access and correct their personal data, as well as to object to its processing in certain cases.

 

§5 [PAYMENT TERMS AND METHODS]

  1. The Client can pay for ordered products using one of the available payment methods, including:
    • bank transfer to the Seller’s bank account (prepayment),
    • via an external online payment provider mentioned in paragraph 2 below (prepayment),
    • cash on delivery, i.e., payment upon receipt of the ordered goods.
  2. Online payment services in the Store are provided by PayPal, which ensures the security of payment transactions.
  3. The Client is obliged to make payment for the order within 7 calendar days from the date of purchase. If payment is not made within this period, the order may be canceled.

 

§6 [DELIVERY METHODS AND COSTS]

  1. The cost of delivery depends on the delivery method chosen by the Client and the delivery location. These costs are provided during the order process and may vary depending on the order size and selected delivery method.
  2. Products are delivered within the territory of the Republic of Poland. The Seller delivers to addresses specified by the Client in the order form.
  3. Delivery of ordered products is carried out by:
    • courier shipment,
    • delivery to parcel lockers.
  4. The delivery cost depends on the chosen delivery method and is visible during order placement.
  5. If payment is made by bank transfer, online payment, or card, the order processing time is up to 4 business days from the moment the payment is credited to the Seller’s bank account. Plant products (e.g., seedlings, live plants) are shipped on specific days of the week, usually Monday to Wednesday.

 

§7 [RIGHT OF WITHDRAWAL]

1. The Client, being a Consumer, who concluded a distance contract, may withdraw from it without giving any reason, by submitting an appropriate written statement within 14 days. To meet this deadline, it is sufficient to send the withdrawal statement provided by the Store.
2. Upon withdrawal, the Sales Contract is considered not concluded, and the Consumer is released from all obligations. What was provided by the parties must be returned in an unchanged state, unless the change was necessary within the scope of ordinary management. The return should be made without undue delay, no later than within 14 days.
3. The Consumer is liable for any diminished value of the Product resulting from handling it beyond what is necessary to establish its nature, characteristics, and functioning.
4. To establish the nature, characteristics, and functioning of the Products, the Consumer should handle and check the Products only in the same way they could do in a stationary store.
5. The Seller will refund the value of the Product. The order value will be reduced by the delivery cost.
6. The Consumer withdrawing from the Sales Contract under point 1 of this chapter bears only the cost of returning the Product to the Seller.
7. The fourteen-day period in which the Consumer may withdraw from the contract starts from the day the Consumer takes possession of the Product.

8. The right of withdrawal from a distance contract does not apply to:

  • contracts for goods made according to the Consumer’s specifications or serving to meet their individualized needs,
  • goods delivered in a sealed package which cannot be returned for health protection or hygiene reasons if the package has been opened after delivery,
  • delivery of digital content not stored on a physical medium, if the performance began with the Consumer’s express consent before the withdrawal period expired and after being informed of the loss of the right to withdraw,
  • sound or visual recordings or computer programs delivered in a sealed package, if the package was opened after delivery.
9. The right of withdrawal applies both to the Seller and the Client (Consumer) if the other party fails to perform their obligation within a strictly specified time.

10. The provisions of this section applicable to the Client as Consumer also apply to natural persons conducting business who conclude contracts related to their business, only when the contract and its circumstances indicate it is not of a professional nature related to their business activity as registered in the Central Registration and Information on Business.
 

§8 [LIABILITY FOR COMPLIANCE WITH THE CONTRACT, COMPLAINT PROCEDURE]

  1. The Seller is obliged to deliver products compliant with the contract. Products offered by the Store are free from legal and physical defects, unless otherwise indicated in the product description.
  2. The Client has the right to submit a complaint in case of discovering a physical or legal defect in the purchased product. Complaints should be sent to the Seller’s e-mail: [email protected].
  3. The Seller shall consider the complaint within 14 business days of receiving it. If the complaint is justified, the Seller will replace the defective product with a new one or repair the product if possible.

§9 [CONTRACTS CONCLUDED WITH ENTREPRENEURS MAKING ORDERS FOR BUSINESS PURPOSES]

  1. The above provisions also apply to contracts concluded by entrepreneurs making purchases related to their business activity.
  2. The entrepreneur placing the order confirms they are authorized to represent the entity on whose behalf the order is placed.

 

§10 [FINAL PROVISIONS]

  • The Seller reserves the right to make changes to these Terms in case of changes in applicable law or rules regarding the conclusion and execution of contracts. Changes will not affect orders already placed, being processed, or executed before the change date.

  • In matters not regulated in these Terms, the provisions of generally applicable law shall apply, in particular the Civil Code of April 23, 1964, and the Consumer Rights Act of May 30, 2014.

  • The Terms come into force on March 27, 2025.
